What a California DUI Test Refusal Means
After a lawful DUI arrest, the law treats drivers as having consented to a chemical test. A California DUI test refusal happens when the officer says the person refused or failed to complete that test. The claim brings its own DMV action and can affect the criminal case too.
Vehicle Code section 23612 sets out the warnings the officer must give. They include the DMV suspension or revocation periods and the fact that a refusal may be used in court.
DMV Periods for a Refusal
The DMV DUI page lists the periods for drivers 21 or older. A first refusal brings a one year suspension. A second within 10 years brings a two year revocation, and a third or later within 10 years brings a three year revocation.
Vehicle Code section 13353 sets the refusal suspension and revocation periods in the same one, two and three year tiers. Also, these periods are separate from anything a court orders after a conviction.
What Counts as a Refusal
A refusal can be words, silence or conduct. Failing to complete a test may count as well. However, the officer must first give the required warning. A driver who could not physically complete a chosen test must take the other available one.
The hearing focuses on these facts. The DMV looks at whether the officer had reasonable cause, whether the person was arrested, whether the warning was given and whether the person refused.
California DUI Test Refusal in Court
In the criminal case, a refusal can lead to harsher terms. Vehicle Code section 23578 lets the court treat a refusal of a breath or urine test as a special factor that may justify enhanced penalties. The court may also weigh it when it sets probation terms.
The prosecution may also argue that a refusal shows awareness of guilt. However, the defense can respond with the facts of what happened.
Hearings and Deadlines
A person who wants a DMV hearing before the action takes effect must ask within 10 days of receiving the notice. The article on DMV DUI hearing deadline explains that clock.
Also, restricted license options can be narrower after a refusal. The guide on California DUI restricted license options covers that topic.
Records That Help
Write down what the officer said about testing, what the person answered and whether any medical issue affected the attempt. A California DUI test refusal often depends on those exact words, so video and notes matter.
The guide on DUI blood draw warrant rules explains when officers seek a warrant for blood.
