How a DUI Temporary License Works
Many drivers leave a DUI arrest without their plastic license but with a paper that lets them drive. That paper is the DUI temporary license. It usually appears on the order of suspension the officer served.
Vehicle Code section 13382 says that when an officer takes a valid license, the officer issues a temporary license. It is an endorsement on the suspension notice and is valid for 30 days from the date of arrest.
Conditions on a DUI Temporary License
The temporary license comes with conditions. The DMV DUI page says the driver may drive for 30 days if the person has a California license that is not expired. In addition, the privilege must not be under suspension or revocation for some other reason.
So an older suspension can cancel the benefit of a DUI temporary license. Check the full record if there is any doubt, because an unpaid ticket or old action may still sit there.
Refusals and Blood Tests
The same temporary license appears in refusal cases and when a driver chose a blood test. Vehicle Code section 23612 requires the officer to serve the notice in those situations too. The temporary license again lasts 30 days from arrest.
The article on California DUI test refusal explains what follows a refusal.
A Notice About Interlock Devices
Vehicle Code section 13390 requires the temporary license to say the person may be able to regain driving privileges with an ignition interlock device. It must also mention that financial help may be available and give a contact for more information.
That notice points toward one way to keep driving later. The guide on California DUI IID requirements explains how interlock rules work.
When the DUI Temporary License Ends
After 30 days, the suspension takes effect unless the DMV has set it aside or stayed it. A hearing request alone does not stay it. The article on DMV DUI hearing deadline explains that point.
So drivers should plan transportation before the last day. The guide on transportation after DUI helps with that.
Keeping the Paper Safe
Carry the DUI temporary license while driving during the 30 days. Vehicle Code section 12951 requires drivers to have their license in immediate possession and to show it to an officer on demand.
Also keep a copy at home. Losing the original can cause confusion at a stop, so a photo on the phone may help as a backup reference.
