When a Public Defender May Be Available for a DUI Case

How a DUI Public Defender Becomes Available

The right to counsel applies in DUI cases. A DUI public defender may represent a person who cannot afford a private lawyer. California law sets out when the public defender steps in.

Many people qualify without realizing it. So asking at the first hearing helps.

The Right to Counsel

Penal Code section 987 says a defendant who appears without counsel must be told of the right to counsel before arraignment. If the defendant wants counsel and cannot afford one, the court must assign counsel. Therefore, nobody has to face a DUI case alone because of cost.

What the Public Defender Does

Government Code section 27706 sets the public defender’s duties. On request or court order, the office defends people who are not financially able to employ counsel. It does so without expense to the defendant at all stages, including the preliminary examination.

The office also gives counsel and advice about the charge it is defending. So a DUI public defender handles the full criminal case.

Asking for a DUI Public Defender

Ask the judge at the arraignment. The court may ask questions about income and expenses. Some courts also use a financial form.

Bring pay stubs, benefit letters and a list of monthly bills. Those papers help the court decide quickly.

The DMV Side

The criminal case and the DMV case run separately. A DUI public defender handles the court case, but the DMV hearing may fall outside that role. So ask early about the DMV deadline.

The guide on DMV DUI hearing deadline rules explains the timing.

Working With a DUI Public Defender

Share every paper from the arrest. Also give accurate contact details and keep them current. Public defenders handle many cases, so clear and organized information helps.

Ask how the office prefers to communicate. Then follow up in writing when possible.

A DUI public defender may also help with record questions later. So keep the office’s contact details after the case ends.

Some people start with a public defender and later hire private counsel, or the reverse. Either way, the new lawyer will need the full file. So ask how files transfer before making a change.
