What Happens During DUI Booking and Release

How the DUI Booking Process Usually Starts

The DUI booking process turns a roadside arrest into a custody record. Officers confirm identity, list personal property and decide how the person will leave custody. Booking records an arrest. It does not show that a court has found anyone guilty.

Families often hear about the arrest hours later and want to know when release will happen. No article can promise a time, because the agency, the charge and the paperwork all affect it.

Identity and Property Records

Staff take identifying details and usually fingerprints and a photograph. They also inventory wallets, phones, keys and belts, so the person should check that list before signing it.

A missing item is easier to trace when the inventory sheet is still in hand. So keep the copy with the other arrest papers.

Release Terms in the DUI Booking Process

Release can happen in more than one way. For many Vehicle Code offenses that are not felonies, an officer can release a person on a written notice to appear. Vehicle Code section 40500 says that notice lists the person’s name and address, the offense charged and the time and place to appear.

Other cases move to a bail decision or a hearing before a judge. Those choices belong to the court and the jail, not to the arresting officer alone.

  • A notice to appear sets a court date and place
  • Bail questions follow the county schedule and any judicial order
  • Release conditions may limit conduct until the case ends

What Families Can Confirm

Relatives can ask the jail for custody status and the expected release process. They can also write down the booking number, the arresting agency and any court date the jail gives out.

However, staff will not give legal advice. When a question turns on the charge or a bail amount, the person needs a lawyer or the court itself. The guide on family DUI support covers how relatives can help without taking over.

What Booking Does Not Decide

The DUI booking process does not file charges. A prosecutor decides that later, and the court date on a notice can still change. The Sacramento Superior Court criminal division lists official contact points for scheduling questions.

Booking also does not settle the driver license question. The DMV runs a separate track with its own short deadline, which the article on DUI court versus DMV explains.

Papers to Keep After Release

Collect every page handed over at release, even ones that look routine. Then sort them before any phone calls start.

  • The notice to appear or release paperwork
  • The property inventory and receipt
  • Any DMV notice or temporary license
  • Contact details for the arresting agency

The article on DUI arrest paperwork explains what each document usually means. Reading them early helps because the court and the DMV each set their own dates.
