Driving While Suspended After a DUI

Why Driving Suspended After DUI Carries Extra Risk

A suspended license after a DUI creates a strict line. Driving suspended after DUI can lead to a new criminal case, more license time and a towed car. California has separate statutes for these situations.

Knowing which rule applies helps a person avoid a second case on top of the first.

Suspension for a DUI Conviction

Vehicle Code section 14601.2 bars driving when the license is suspended or revoked for a 23152 or 23153 conviction and the driver knows it. It also bars driving outside the terms of a restricted license. Mailed notice from the DMV creates a conclusive presumption of knowledge.

A first conviction under that section brings 10 days to six months in county jail and a fine of $300 to $1,000. Within five years of a prior, the range rises to 30 days to one year and $500 to $2,000.

Suspension After a Test or Refusal

A different statute covers administrative suspensions. Vehicle Code section 14601.5 bars driving while suspended under the DMV’s chemical test rules, including the refusal and APS sections, when the driver knows of the suspension. A first conviction can bring up to six months in jail or a fine of $300 to $1,000, or both.

So a person can face this charge before the DUI case ends. The article on California APS suspension rules explains that first suspension.

Driving Suspended After DUI and the Vehicle

Officers also have impound power. Vehicle Code section 14602.6 lets an officer seize a vehicle when the driver’s license is suspended or revoked. It also covers a driver on a restricted license without a required interlock.

The guide on DUI vehicle impound rules explains release steps and fees.

Interlock Rules

Section 14601.2 also ties to interlock devices. After a conviction under that section, the DMV will not reinstate the license until it receives proof of installation. Therefore, a new charge can lengthen the path back to a valid license.

Avoiding Driving Suspended After DUI

Check license status with the DMV before driving. Also keep any restricted license papers in the car. If work requires driving, ask about a restricted license, which the article on California DUI restricted license options covers.

Rides from friends, transit or rideshare can bridge the gap. In addition, the guide on transportation after DUI lists other options.

A person who drives on a suspended license may also face a probation violation claim in the DUI case. That is because new offenses breach a standard DUI probation term. So driving suspended after DUI can create trouble in two cases at once.
