What DUI Expungement Can and Cannot Change in California

What California DUI Expungement Means

People often call record relief an expungement. In practice, California DUI expungement usually means a dismissal under Penal Code section 1203.4. It changes some effects of a conviction but not all.

Understanding the limits helps set realistic expectations. It also helps with job and license questions later.

Eligibility After Probation

Penal Code section 1203.4 applies when a person has fulfilled probation, received an early discharge or the court finds relief fits the interest of justice. The person must not be serving a sentence, on probation or facing charges. Then the court allows withdrawal of the plea and dismisses the case.

The statute then releases the person from most penalties and disabilities of the conviction. However, the statute lists exceptions.

What California DUI Expungement Does Not Change

Section 1203.4 still lets the prosecution plead and prove the prior conviction in a later case. So a dismissed DUI can still count as a prior under California DUI expungement rules. It also says the person must disclose the conviction on applications for public office or state licenses when asked directly.

In addition, Vehicle Code section 13555 says this relief does not affect DMV suspensions or revocations. The conviction still counts for license purposes.

Cases Without Probation

Penal Code section 1203.4a covers misdemeanors where the court did not grant probation. It applies one year after judgment if the person complied with the sentence and meets other conditions. So people without probation have a path too.

California DUI Expungement and Employment

California limits how employers use dismissed convictions. Labor Code rules bar employers from asking about convictions dismissed under section 1203.4. The article on DUI employer disclosure rules explains more.

Starting the Process

The California Courts self help guide walks people through ways to clean a record. It asks questions to match the right process. Noncitizens should review its note on immigration effects first.

Also consider early termination of probation, which the guide on DUI probation early termination explains. The article on DUI record duration covers how long records remain.

California DUI expungement helps many people with job searches. Still, keep in mind the limits for priors, licenses and the DMV record.

Also note that relief is not automatic in every case. The court reviews the petition and may ask for proof of completed terms. So gather program certificates and payment records before filing.

Each step takes time.
