Why a Personal Breathalyzer Cannot Promise Safe or Lawful Driving

The Problem With Personal Breathalyzer Accuracy

Small breath devices sell as a way to check before driving. Yet personal breathalyzer accuracy varies from device to device and from use to use. More important, a reading below a legal limit does not mean a person can drive safely or lawfully.

The California Driver Handbook says a BAC below the legal limit does not mean driving is safe. It also says a person may be arrested and convicted of DUI even without a BAC measurement, depending on impairment.

Why Readings Can Mislead

A personal device is not held to the same rules as an evidential instrument. California evidential breath testing follows Title 17 section 1221.2, which requires two samples, regular accuracy checks and trained operators. A consumer device has no such program behind it.

Timing also matters. Alcohol levels can keep rising after the last drink. So a reading taken right after drinking may be lower than the level a short time later.

Personal Breathalyzer Accuracy and the Law

California sets several limits. The handbook lists 0.08 percent for drivers 21 and older and 0.01 percent for drivers under 21. It also lists 0.01 percent for drivers on DUI probation and 0.04 percent for commercial drivers and for drivers carrying paying passengers.

Even below those numbers, impairment alone can support a charge under Vehicle Code section 23152(a). The article on DUI below legal limit cases explains how that works.

Common Mistakes

People sometimes use a device the wrong way. For example, they test right after a drink, skip the waiting time in the instructions or rely on one number.

  • Testing too soon after the last drink
  • Ignoring the maker’s calibration schedule
  • Treating one low number as permission to drive

Each mistake can produce false confidence.

Better Choices Than a Number

A personal device can be a reminder that alcohol is present. It is not a green light. A sober driver, a rideshare trip or a night’s stay are safer choices.

Drivers on probation or under 21 face especially tight limits. The guide on California underage DUI rules explains the zero tolerance standard.

When a Device Reading Comes Up in a Case

Some drivers mention a personal reading to police. That statement may appear in the report. Personal breathalyzer accuracy is rarely strong evidence either way, so a lawyer will weigh it carefully against the official tests.
